this letter is a Bona Fide Job Offer for you to return to work as a Staff Assistant at a local nonprofit organization (NPO) for a temporary, modified duty assignment, with participation in Advantage Solution’s (or the “Company”) workers’ compensation Temporary Transitional Duty Program (“TTDP” or the “Program”). The Program is intended to provide you an alternative, short-term work assignment through an Advantage Solutions program within your current work restrictions.

Casual clothes are recommended attire: business appropriate jeans and shirts with no offensive logos, messages, or advertisements are acceptable. Closed toe shoes are required. Attire should be neat, clean, business appropriate, and otherwise in keeping with the Company’s policies.

TTDP Assignment Job Duties
Your job duties in connection with the TTDP will consist of the following:

Tasks are self-paced, not production oriented.
Other tasks may be assigned within physical restrictions. Tasks are self-paced, not production oriented.
You will only be assigned tasks believed to be consistent with your medical restrictions related to your workplace injury , any additional on-the job training will be provided as needed.
Assignment Duration
The TTDP assignment is temporary in nature and not intended to be an ongoing re-assignment. The assignment is currently anticipated to continue for the period identified above or until you have been released to full duty, maximum medical improvement, or for ninety (90) days, whichever comes first. If you have not returned to work within 90 days of you starting the TTDP assignment described above, you may be placed on a leave of absence as available under Company policy or applicable law. (Notwithstanding anticipated duration of assignment, please see reminder regarding at-will employment below.)
Timekeeping
A weekly timesheet will be prepared by the Organization Point of Contact and will be given to you each week to sign so it can be sent via email to rtw@twsworks.com or faxed to 800-640-0674. Advantage Solutions’ workers compensation manager, will be provided a copy of the signed time card, which will be processed in accordance with Advantage Solutions’ designated bi-weekly payroll calendar. It is anticipated that your work schedule during the TTDP will not exceed your average hours worked per week in connection with your pre-injury employment; notwithstanding any estimates, guidelines, or schedule, you are expected to accurately record all hours worked in connection with any work for Advantage Solutions, including hours worked in connection with your TTDP assignment.
Expenses
Mileage reimbursement or transportation allowances, to the extent you were eligible to receive these benefits during your pre-injury employment will not be paid during the TTDP assignment as you will not be expected to drive other than your personal commute between home and your TTDP assignment worksite. In addition, you will not be expected to incur any other business expenses during your TTDP assignment. Should you incur any business expenses (including business mileage other than related to the personal commute), please contact me immediately so that you can be reimbursed as appropriate and so that guidance can be provided to avoid any unnecessary expenses during the remainder of the TTDP assignment.
Employment and Company Policies
- During your TTDP assignment, you will remain an employee of the Company (and will not become an employee of the Organization). Accordingly, you will remain subject to Company policies and procedures (including but not limited to those set forth in the Associate Handbook and Code of Business Conduct & Ethics).
- Neither the TTDP assignment nor any representation in this letter (including the anticipated duration of the assignment) creates a guarantee of employment for any specific period of time or changes the at-will nature of your employment with the Company (which means that either the Company or you may terminate the employment relationship at any time with or without notice or cause).
- The terms and conditions of your employment (other than those set forth herein specific to the TTDP assignment) remain in effect. As a further reminder, all terms and conditions of employment (including those set forth in this letter) are subject to change at any time with or without notice or cause, as permitted by law.
- As an associate of the Company, you should continue to use the Company’s Open Door Policy to raise any questions or concerns regarding your employment or workplace (including any which may arise during or in connection with your TTDP assignment). The channels of the Open Door Policy include your supervisor, next level managers, and Human Resources; as well as an Ethics Line which may be used 24/7 and accessed online at www.ethicspoint.com or by phone at 888-325-7882.
Work Schedule Expectations
As noted above, the Company policies, including those pertaining to attendance and communication expectations, will continue to apply to your employment during the TTDP assignment. Any requests for changes to the above schedule should be discussed with the Organization Point of Contact listed above.
Accepting or Declining Offer
While it is our hope that you will take advantage of this temporary assignment, you are not required to do so. If you decline this temporary assignment offer, you will be entitled to continue to receive applicable medical benefits as otherwise provided in connection with your approved workers’ compensation claim. However, you may or may not be entitled to continuation of lost time wage benefits. All decisions regarding additional workers’ compensation benefits will be made by a third-party in accordance with your state’s workers’ compensation laws and rules. If you decline this job offer, or, if you elect not to sign and return this letter the Company will conclude that you have declined this temporary assignment offer and you will be placed on or remain on a leave of absence as may be available under Company policy or applicable law pending further review.
